1. About Us

SineThamsanqa Business Solutions is a South African web design and digital marketing company offering services designed to help your business succeed online. Our areas of expertise include:

2. Payment Terms

2.1 Website Design Only

  • Payment is strictly 50% upfront with the remaining balance due upon project approval.
  • Work will be conducted on a staging platform controlled by SineThamsanqa Business Solutions.
  • Clients may opt to pay the full amount upfront.
  • No work will commence without a deposit or full payment upfront.

2.2 Other Services

(WordPress Hosting, Domain Registration/Transfer, Social Media Management, WordPress Maintenance)

  • Payment is strictly 100% upfront.
  • Services will only begin once payment is received and confirmed.

2.3 Automation & Email Marketing

  • Prices listed on our website reflect the cost of completing the project using our tools.
  • If the client wishes to manage the automation independently, they will be responsible for any platform or tool costs.
  • A one-time setup fee will be charged for projects managed by the client.

3. Service Cancellation

3.1 Hosting Services

A full calendar month's notice is required for the cancellation of any hosting service.

3.2 Month-to-Month Services

Month-to-month service cancellations (Social Media, SEO, Maintenance, etc.) also require a full calendar month's written notice sent to info@cloudst.co.za.

If an account is 19 days overdue, the cancellation process begins automatically. Data may be provided in .zip format for a fee of R 350 if the account is not in good standing.

4. Service Turnaround Times

4.1 Website Design (One-Page / Landing Page)

  • Turnaround time is 3 business days upon receipt of the deposit and all required access credentials.
  • Clients have 3 business days to review the completed work and provide feedback.

4.2 Review & Feedback Process

If no feedback is received after delivery, we will send reminder emails:

  • Day 1: Initial reminder
  • Day 2: Second reminder
  • Day 3: Final reminder

If there is no response by the end of the third business day, we will consider the project approved and the outstanding balance will be required before files are released or the site is published.

If the client ceases communication, the website will not be published. Payments already made will not be refunded. Files will be retained for 3 months and then permanently deleted. SineThamsanqa Business Solutions reserves the right to use completed projects for marketing and portfolio purposes.

5. Invoicing & Subscription Services

  • Invoices for subscriptions and retainers are issued on the 20th of each month, with the due date being the last day of that month.
  • Domain renewal invoices are issued annually, one month before the month the domain expires, and are strictly due by the invoice date to avoid immediate cancellation.
  • Periodic payment reminders are sent before and after the due date.
  • Payments must include the company name, domain name, or invoice number for identification purposes.
  • Hosting services will be suspended on the 1st of the following month if payment has not been received by the due date.

All payments must be made directly to our business bank account. Credit refunds are processed to a verified bank account only. We do not process payments via CashSend or e-wallet services.

6. Intellectual Property & Usage Rights

  • All materials, designs, and content developed by SineThamsanqa Business Solutions remain the intellectual property of our company until full payment is received.
  • Upon receipt of full payment, all ownership rights for the deliverables are transferred to the client.
  • We reserve the right to use completed projects, designs, and other materials created for clients in our portfolio and for promotional purposes, unless explicitly agreed otherwise in writing.
  • Third-party assets (stock photography, licensed fonts, plugin licences) may be subject to their own usage terms, which we will disclose where relevant.

7. Client Responsibilities

To ensure the smooth delivery of our services, clients are responsible for:

  • Providing accurate, complete, and timely information required to complete the project
  • Responding to communications and review requests within the agreed timeframes
  • Granting necessary access to platforms, accounts, and systems (hosting, social media, domain registrar, etc.)
  • Maintaining their own additional backups if storage beyond our 3-month retention period is required
  • Ensuring that any content or materials provided to us do not infringe on any third-party intellectual property rights

8. Limitation of Liability

SineThamsanqa Business Solutions will not be liable for any indirect, incidental, or consequential damages arising out of the use or inability to use our services, including but not limited to:

  • Loss of data, revenue, or profits
  • Downtime caused by third-party hosting providers or infrastructure failures
  • Search engine algorithm changes that affect rankings after our work is complete
  • Third-party platform policy changes (social media algorithms, Google Ads policies, etc.)

Our maximum liability in any event will not exceed the total amount paid by the client for the specific service in question.

9. Termination of Service

We reserve the right to terminate services immediately and without refund in cases of:

  • Non-payment — accounts overdue beyond the grace period
  • Misuse of services — including using our platforms for illegal, unethical, or harmful activities
  • Violations of these Terms & Conditions
  • Abusive or threatening conduct directed at our team members

In cases of termination for cause, no refund will be issued for services already rendered. We will provide reasonable notice where possible.

10. Amendments to Terms & Conditions

SineThamsanqa Business Solutions reserves the right to update these Terms & Conditions at any time. When material changes are made:

  • Clients will be notified via email or a notice on our website
  • Continued use of our services after the effective date constitutes acceptance of the updated terms
  • The current version of these Terms will always be available at cloudst.co.za/terms-conditions.php

11. Service Suspension

SineThamsanqa Business Solutions reserves the right to suspend services in cases of:

  • Non-payment beyond the due date
  • Misuse of services or platforms
  • Violations of these Terms & Conditions

Hosting services will be suspended on the 1st of the month if the prior month's invoice is unpaid. A reconnection fee may apply upon reinstatement.

12. Refunds

  • Refunds are processed within 3–5 business days of approval.
  • No refunds will be processed for completed projects — including projects that have been fully or partially paid for after the project has been completed or after the client has approved the project.
  • Deposits are non-refundable once work has commenced.
  • Refunds for unused subscription periods are assessed on a case-by-case basis and are at the discretion of SineThamsanqa Business Solutions.
  • All refunds are paid to a verified South African bank account only.

13. Updated Service Rate Card (Pay-As-You-Go)

For any requirements outside of your active service plan, the following rates apply. All fees are paid upfront before work commences.

New Feature Development From R 2,400 3-day turnaround from receipt of payment & brief.
Graphic Design R 550 per design Includes 3 rounds of revisions.
Social Media Management From R 2,900/month 3 posts per week, excluding ad spend.
New Project on Existing Domain From R 3,500 Subject to scope discussion & approval.
Data Export (.zip) R 350 For accounts not in good standing at cancellation.
Site Audit & Takeover Fee R 1,500 For existing sites built by a third party.

Key Service Rules Summary

  • Hosting: Payments due by the last day of the month. Suspended on the 1st if unpaid.
  • Cancellations: 19-day overdue threshold triggers the cancellation process.
  • Domain Renewals: Strictly due by the invoice date to avoid immediate suspension.
  • Subscriptions: Invoiced on the 20th; due last day of the month.
